To be compliant with the new cookie law, introduced by the ICO in May 2011 and which is active from May 26th 2012, businesses have to demonstrate that they are actively seeking website visitors’ permission to place cookies on their viewing device, therefore instigating an opt-in process for cookie placement.
The maximum penalty for failure to comply with this new law is £500,000.
This law is primarily aimed at organisations that use advanced tracking/advertising cookies, with the ICO appearing more sympathetic to companies that use cookies just for improving website functionality and for gathering website traffic information with analytics. This ‘leniency’ is highlighted by their positive view of a cookie guide for business produced by the UK branch of the International Chamber of Commerce.
This 15 page ICC guide provides useful information and advice on how to approach the new cookie law and defines the cookies used on websites into four separate categories (although, naturally, there is a degree of overlap).
The categories they use are, in broad terms:
- Strictly necessary cookies (make the website work so no opt-in required)
- Performance cookies (includes analytics - opt-in required)
- Functionality cookies (remembering visitor actions etc. - opt-in required)
- Targeting or Advertising cookies (self-explanatory - opt-in required)
No 1 does not require an opt-in and no’s 2 & 3 do not require a proper opt-in according to the ICC guide, with only the targeting/advertising cookies requiring the ‘tick-box’ option or similar.
Achieving compliancy is gained through a three stage process:
First: Conduct a cookie audit to evaluate all the cookies used on your website and their functionality.
Second: Review and rewrite the cookie section of your website Terms of Use/ Privacy Statement to conform with the new law in relationship to cookie use on your website - likely to require legal input.
Third: Produce the appropriate opt-in statement/action, which will be dependent on the type(s) of cookies used and their function.
